Abstract

The paper analyzes, in both theoretical and concrete terms, the powers delecated on independent Authorities in order to ascertain whether they include elements profiles of political discretion. After ruling out the possibility that the constitutional position of the Independent Authorities allows them to exercise discretionary powers, it outlines the role that, in the decision-making process, political bodies must assume, according to the limits imposed by European law to guarantee the functional independence of the Authorities
