Abstract

With sentence no. 7703/2022, the third section of the Campania Administrative Court confirmed the legitimacy of the use of algorithms in the administrative procedure, provided that full knowledge of the algorithm used is ensured - so as to allow full attribution of the deed and consequent responsibilities adoption of the final decision by the body holding power (with guarantee of knowability of the logics that inspired the automated administrative action) - and respect for the principle of non-exclusivity of the algorithmic decision.
