Abstract

The essay analyzes the development of competitive relations between the State and the Regions in the field of health protection and health risk management in the light of the recent judgment of the Constitutional Court no. 37/2021. The judgment, in fact, in underlining the strong dimension of state legislative power, marks a profound change in the delimitation of the boundaries of international prophylaxis that takes the form of an "implicit supremacy clause" for the sake of certainty and uniformity throughout the national territory, therefore likely to condition the results of sector reforms and the constitutional reform project.
