Abstract

The article describes the phenomenon of personal data capitalization and examines the recent judgments that establish the protection of digital services users is articulated on a dual level and is based on both privacy and consumer protection regulations. Starting from this introduction, the article proposes some considerations on the collective effects resulting from the exploitation of personal data, questioning the need for public policies that, going beyond the consumer protection, are able to cope with the consequences produced by the data economy.
