Riforma in itinere degli artt.9 e 41 della costituzione: l’habitat umano quale bene collettivo unitario

Abstract

The constitutional bill C. 3156, approved on 9 June 2021 by the Senate Assembly in a unified text (S. 83 and combined), modifies Article 9 and Article 41 of the Constitution, in order to introduce the protection of the environment in their forecasts.
In this way, the aim is to articulate the principle of environmental protection, in addition to the mention of "protection of the environment, ecosystem and cultural heritage" provided for by Article 117, second paragraph of the Constitution - introduced with the reform of the Title V approved in 2001 - in the part in which it lists the matters over which the State has exclusive legislative competence
