Profili di attuazione dell’autonomia differenziata e modelli di amministrazione locale


Abstract


The work analyses the question of “asymmetric” regionalism and the role of the principle of differentiation, with particular reference to the concrete application of the article 116, third paragraph of the Italian Constitution.
Are examined, in this way, the contents of the preliminary agreements stipulated by the Lombardy, Veneto and Emilia-Romagna Regions with Government. The agreements, even if with very different starting points in terms of quantity and quality of the demands for autonomy, have resulted in a similar scheme of the structure for all the Regions that made the request.

These agreements, for some of the subjects, have interesting ways of characterizing differentiated autonomy. They offer, in fact, a possible way of applying the content of provision of the article 116, third paragraph of Italian Constitution, when it uses the expression: “further forms and particular conditions of autonomy”, even with original solutions, able to have further and unpredictable developments, worthy of attention.
