Abstract
In the relationship between property rights, specifically defined as ius aedificandi, and urban planning, there has always been a tension between the individual interest in the economically advantageous use of property and the public interest in an orderly and planned urban development of the territory.
It has long been clear that the power of the public administration, which defines the content of property rights in relation to a generality of assets (Article 42, paragraph 2, of the Constitution), does not assume an expropriative legal nature. That is, limits and obligations are placed on private property while preserving its economic use.
