La libertà educativa in Spagna: educazione differenziata, diritti dei genitori e superiore interesse del minore

Abstract

This article reconstructs the legal configuration of educational freedom in Spain — the rights of teachers, parents and school founders — set within a regulatory environment far more volatile than its Italian counterpart. It examines the constitutionality of single-sex education, a model that in Italy survives only residually, and applies Constitutional Court case law on parental disputes over children's upbringing to the specific conflict of choosing between mixed and single-sex schooling, guided by the best interests of the child.
