Il potere amministrativo alla prova del tempo: limiti temporali, affidamento e carattere (in)esauribile dell’autotutela amministrativa

Abstract

This case note examines Council of State judgment no. 1761/2026 on the temporal limits of administrative self-review under Article 21-nonies of Law no. 241/1990. The ruling holds that the time limit runs from the final award, not from the later budgetary commitment, and that the award already confers a protected economic advantage. It thus strengthens legal certainty, legitimate expectations, and the exhaustible nature of administrative power, in line with Constitutional Court no. 27/2025.
