L'effettività dei Modelli Organizzativi al vaglio del caso Cosenza Calcio

Abstract

The decision of the CONI Guarantee Board (Collegio di Garanzia), No. 20 dated March 19, 2025, concerning the Cosenza Calcio case, stands as a pivotal moment in sports jurisprudence regarding club liability and the assessment of Organization, Management, and Control Models (Modelli di Organizzazione, Gestione e Controllo - MOGC) pursuant to Article 7 of the Italian Sporting Justice Code (Codice di Giustizia Sportiva - CGS). Through the analysis of this emblematic case study (casus), this work highlights the necessity of a non-formalistic approach in ascertaining the effectiveness of MOGC and the affirmation of substantive effectiveness as a conditio sine qua non for the exemption or mitigation of the liability of sports associations.
