Art. 50 D.Lgs. 36/23, un difficile equilibrio tra istanze di semplificazione procedurale ed interpretazione comunitariamente orientata


Abstract


This paper focuses on the role of the simplified procedure, ex art. 50 D. Lgs. 36/2023, for the award of contracts below the EU threshold in the context of public contracts. The rule is at the centre of extensive doctrinal and jurisprudential debate, as it seems to pose problems of compatibility with some of the cardinal principles of the system. Despite the intervention of MIT which, in Circular No. 298 of 2023, clarified that administrations are free to choose the awarding procedure they deem most appropriate, some doubts remain. After analysing the role of the art. 50 in the new Contracts Code and identifying the relevant european and national law principles of the system, the paper aims to identify a way to overcome the critical issues. In the absence of intervention by the Legislature, the new principle of the result, pursuant to Article 1 of Legislative Decree No. 36/2023, could be the way to get to a Community-oriented interpretation of the rule in question.
