Tendenze evolutive dell’ordinamento amministrativo: risultato negoziale e principio di legalità nell’amministrazione per contratti


Abstract


Developments in public contract law represent a privileged field for the emergence and recording of trends in the entire system of administrative law. In the era of disciplinary contaminations and the decline of the public-private dichotomy, public contracts are part of the evolutionary processes of administrative law, anticipating its transformations. The new code of public contracts opens with the formulation of the principle of the result that assumes a scope that goes beyond the scope of public contracts. The introduction by law of a principle (which appears) as innovative as the result, which has so far been the subject of theoretical perspectives of a part of the doctrine and of some rare and timid rulings of the administrative and accounting courts, leads us to investigate its foundation in terms of general theory, its scope, its reviewability and how it stands with respect to the principle of legality.
