Abstract
The success of electronic commerce in the private sector has acted as a lever to take advantage of the potential of the internal market and thus contribute to a more efficient and complete management of public procurement in the European Union.
The European Union Directives on public procurement have highlighted the importance of incorporating electronic means in the management of public tenders. In this sense, the repealed Directive 2004/18/EC of the European Parliament and of the Council, of March 31, 2004, on the coordination of procedures for the award of public works, supply and services contracts incorporated these provisions in order to that they serve as an instrument of publicity and reinforcement of transparency in award procedures. However, these provisions had to comply with the principles of equal treatment and non-discrimination between bidders.
