Il silenzio assenso “orizzontale” della Soprintendenza nel procedimento “pluristrutturato” di accertamento di compatibilità paesaggistica dopo la legge Madia (l. 7 agosto 2015, n. 124, introduttiva dell’art. 17 bis della legge n. 241/90)
Abstract
The sentence that is noted (TAR Campania Napoli, Section VI, Pres. Passoni, Est. Buonauro, of April 17, 2019, filed on June 7, 2019) represents the first important precedent in Italy, after the introduction, with law no. 124/15 (art. 3), of art. 17 bis of law no. 241/90 (concerning "Delegations to the Government on the reorganization of public administrations. Silence of consent between public administrations and between public administrations and managers of public goods or services"), in relation to the special landscape compatibility assessment procedure of which art. 167 of Legislative Decree no. 42/04.
The ruling has the merit of having given an answer, with lucid and tranchant motivation, to the topic, still subject to interpretative debate, of the application to the landscape assets of the institute of silent assent between public administrations.
